Immigrant's Rights

TRANSCRIPT: Council de Manos with solidarity organizations (Alma de Muxeristas Deaf Queer Resource Center, Illinois Deaf Latino Association - IDLA, Latinx Student Union, & Raíces del Rio Grande) is heartbroken at the rise of hateful action against our Latinx community and the trauma our Latinx community is experiencing. We honor our Latinx Deaf, DeafBlind, DeafDisabled, Hard of Hearing & Late Deafened communities and their experiences. We stand in solidarity against all violence and join you in mourning every single death as a result of that hatred.

Council de Manos recognizes the value of having access to information and resources. In this vlog our focus is to provide tips and defenses against Immigration and Customs Enforcement (ICE) in order to protect your rights. There will be links on our website for you to check if you need more information.

Alma de Muxeristas: Melissa Yingst
You do have rights when it comes to dealing with ICE. ICE will lie to you and threat you in order to make you cooperate. ICE will not have an ASL or LSM interpreter with them.

Council de Manos: Dexter Jones
First and most important always tell your family and friends where you are going, how long you will be gone, what your plans are, how you are getting there (what bus/train you will take or what car and what freeway/roads you will take), and what time you plan to be home. Set up a group text with people you trust.

Council de Manos: Jon Ferrales
ICE will pretend to be regular police officers. Always ask to see their identification. ICE will make up stories and ask you to help them. Do not believe them.

Council de Manos: Susan Gonzalez
You do not have to let ICE in your home. Ask to see a warrant. A warrant is a court document signed by a judge that gives ICE permission to enter your home, search your home, search you, and to arrest you. ICE may say they have a warrant but it may not be signed by a judge. That means that warrant is not valid. A warrant signed by ICE people is not valid. It must be signed by a judge

Do not give them any information. Do not tell ICE where to find someone.

Council de Manos: Jojo Lopez
If ICE arrests you do not fight back or run away. Ask for a lawyer. Keep asking for a lawyer until you get one. Do not offer any information or answer their questions or sign any papers. Do not give them your identification or travel documents. ICE must have a valid warrant in order to take your travel documents.

Immigrants’ Rights Regardless of your immigration status, you have guaranteed rights under the Constitution. Learn more here about your rights as an immigrant, and how to express them.

If ICE Agents Show Up at Your Door:

Latinx Student Union: Pablo Gonzalez
  • Don’t open the door, but be calm. You have rights.

Illinois Deaf Latinos Association: Juan Bernal-Mondragon
  • Ask what they are there for (and ask for an interpreter if you need one).

Alma de Muxeristas: Blanca Altamirano
  • If they ask to enter, ask if they have a warrant signed by a judge (an ICE administrative warrant from I-200, I-205 does not allow them to enter your home without your consent) and if so, ask to see it (through a window or slipped under the door).

Council de Manos: Janette Durán
  • If they do NOT have a warrant signed by a judge, you may refuse to let them in. Ask them to leave any information at your door.

Council de Manos: Roberto Cabrera
  • If they force their way in, don’t resist. Tell everyone one in the residence to remain silent.

Raices del Rio Grande: Rosie Ferrales
  • If you are arrested, remain silent and do not sign anything until you speak to a lawyer.

TRANSCRIPCÓN: El Consejo de Manos con organizaciones solidarias, (Alma de Muxeristas, Asociación de Latinos Sordos de Illinois, Centro de recursos para sordos queer, Raíces del Rio Grande, Unión Estudiantil Latinx), es un desconsuelo ante el aumento de las acciones de odio contra nuestra comunidad Latinx y el trauma que está experimentando nuestra comunidad Latinx. Honramos a nuestras comunidades Latinx sordos, sordociegos, sordos deshabilitados, hipoacúsicos/ sordera progresiva y sus experiencias. Nos solidarizamos contra toda violencia y nos unimos a ustedes en duelo por cada muerte como resultado de ese odio.

El Consejo de Manos reconoce el valor de tener acceso a información y recursos. En este blog nuestro enfoque es el de proporcionar consejos y amparo contra la Inmigración y Control de Aduanas (ICE) con el fin de proteger sus derechos. Habrá enlaces en nuestras redes de internet para que usted verifique si necesita más información.

Usted tiene derechos cuando se trata de tratar con ICE. ICE te mentirá y te amenazará para hacerte cooperar. ICE no tendrá un intérprete de ASL o LSM con ellos.

Lo primero y lo más importante siempre es decirle a su familia y amigos a dónde va, cuánto tiempo se ausentará, cuáles son sus planes, cómo llegará allí (qué autobús / tren tomará o qué auto y qué autopista / carreteras tomará toma), ya qué hora planeas estar en casa. Configura un texto de grupo con personas de confianza.

ICE fingirá ser policías regulares. Siempre pida ver su identificación. ICE inventará historias y les pedirá que las ayuden. No les creas.

No tienes que dejar entrar a ICE en tu casa. Pida ver una orden judicial. Una orden judicial es un documento judicial firmado por un juez que otorga permiso a ICE para ingresar a su hogar, registrar su hogar, registrarlo y arrestarlo. ICE puede decir que tiene una orden, pero no puede ser firmado por un juez. Eso significa que la orden no es válida. Una orden firmada por personas de ICE no es válida. Debe ser firmado por un juez.

No les dé ninguna información. No le digas a ICE dónde encontrar a alguien.

Si ICE te arresta, no te defiendes o huyes. Pida un abogado. Sigue pidiendo un abogado hasta que consigas uno. No ofrezca ninguna información ni responda a sus preguntas ni firme ningún documento. No les dé su identificación o documentos de viaje. ICE debe tener una orden de registro válida para poder llevar sus documentos de viaje.
